§ 1 Scope

These Terms apply to the use of the mobile application (hereinafter “App”) operated by Georg Pawlitschko, Sudetenlandstraße 61, 85221 Dachau, Germany (hereinafter “Provider”). The App is aimed exclusively at consumers within the meaning of § 13 of the German Civil Code (BGB).

§ 2 Subject matter and service description

The App enables users to create profiles for their pets and to document information about health, nutrition and activities. The basic features are free of charge and financed via Google AdMob. In addition, a paid premium subscription is offered, unlocking further features and/or removing advertising. The Provider does not owe any medical or veterinary advice.

§ 3 Conclusion of contract and registration

By downloading and first using the App, the user agrees to these Terms. The usage contract is concluded upon completion of the registration. The user is responsible for keeping their access credentials confidential.

§ 4 Premium subscription, prices and payment

Premium subscriptions are taken out via the Apple App Store or Google Play Store. Billing is processed through the payment method stored in the respective store, including statutory VAT. The subscription renews automatically unless cancelled at least 24 hours before the end of the term via the store settings. Price changes are communicated in good time before the next renewal period.

§ 5 Right of withdrawal

Consumers generally have a right of withdrawal in accordance with §§ 355 et seq. BGB. To the extent that the purchase is processed via the Apple App Store or Google Play Store, the withdrawal and refund policies of the respective store operator apply.

§ 6 Advertising and Google AdMob

The free version contains advertisements from Google AdMob (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). Personalised advertising only takes place with the user’s prior consent in accordance with Art. 6 (1) lit. a GDPR. Users can revoke their consent at any time in the App settings.

§ 7 Cloud sync (optional premium feature)

The App offers an optional cloud sync feature that enables synchronisation of data across multiple devices (iPhone, iPad, Android) as well as family sharing. Use of cloud sync requires an active paid subscription (Pro or Ultimate).

Data storage and encryption: All data transmitted and stored via cloud sync is held exclusively on European servers operated by the service provider Supabase (Supabase, Inc., 970 Toa Payoh North #07-04, Singapore 318992; server location: EU). Data is end-to-end encrypted on the user’s device before it ever leaves the device. Neither the Provider nor Supabase has any technical access to the plaintext content of the stored data.

Processing by Supabase: Supabase processes only encrypted data packets as a data processor within the meaning of Art. 28 GDPR. Any knowledge of or access to the content of the data by Supabase is technically impossible. Further details on data processing in connection with cloud sync are set out in the Privacy Policy.

Cancellation and deletion: Upon cancellation of the subscription or the user account, all data stored in the cloud will be deleted in accordance with the Privacy Policy. Without an active subscription, locally stored data on the device remains available.

§ 8 User obligations

The user undertakes to use the App lawfully. The following are particularly prohibited: unlawful content, abusive use of the infrastructure, automated procedures (bots, scrapers) and the violation of third-party rights.

§ 9 Availability and warranty

The Provider endeavours to ensure uninterrupted availability as far as possible; however, there is no entitlement to this. Warranty claims are governed by §§ 327 et seq. BGB.

§ 10 Liability

The Provider is liable without limitation in cases of intent, gross negligence and damages arising from injury to life, body or health. In the event of slightly negligent breach of a cardinal obligation, liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability is excluded.

§ 11 Term and termination

The usage contract for the basic features is concluded for an indefinite period and can be terminated by either party at any time. After the contract ends, the user account is deleted; the user can export their data beforehand.

§ 12 Data protection

The processing of personal data takes place in accordance with the Privacy Policy, available on this website.

§ 13 Changes to the Terms

Changes will be communicated to the user in text form at least six weeks before they take effect. They are deemed accepted if the user does not object before they take effect.

§ 14 Dispute resolution

The EU Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. The Provider is not willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 15 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
